Probate 

Probate is the process where the estate of a deceased person is dealt with and distributed to the beneficiaries of the will. A grant of probate (where there is a will), or letters of administration (where there is no Will), is normally required before the estate of a deceased person can be distributed. The estate can consist of property, money or other possessions. When someone dies their assets passes into the hands of the executor’s, but in order for their property or other assets to be divided according to their wishes, the executor must apply to the Probate office to take out a grant of Probate. The assets or estate of the deceased cannot be administered until the grant of probate is received from the Probate office.

Even where a person dies without leaving a valid will, their estate still needs to be dealt with. In those circumstances grant can be applied for and issued to the person or persons who were their nearest next of kin at the date of death and this is governed by legislation.
